Next question, with a conviction rate of 2%-6%, the alleged perp would probably have got off so why not take the chance? What? He couldn't off himself later in jail?
And lastly, but not leastly, if you have a gun, why not shoot the cops and make a run for it?

Johannesburg - A 30-year-old man shot himself dead in the back of a police vehicle in Calcutta near Bushbuckridge, Mpumalanga police said.
Superintendent Abie Khoabane said the man had been wanted by police for attempted murder and was arrested around 09:30 on Tuesday.
He was placed in the back of the police van where he apparently shot himself.
An internal investigation was being conducted to determine why the man had not been properly searched before being placed in the back of the van, said Khoabane.
